TERMS AND CONDITIONS OF USE OF THE WEBSITE

These Terms and Conditions of Use of the Website (hereinafter, «TCUW»), govern the access to and use of the property of MORMEDI, S.L., with Spanish Tax ID No. B-79.378.394 and registered address at Plaza República Argentina 3, in 28002 Madrid (Spain), which the user of the Website must read and accept in order to benefit from all the services provided by the Website.  

The user and MORMEDI, S.L., owner of the Website, may be jointly called “the Parties”.

The use of the Website, of all or part of its contents and services, or the mere access to it, entails full acceptance of the terms of use. Using the Website is subject to strict compliance of the terms included in these Terms and Conditions of Use of the Website. However, access to and use of certain contents and/or services may be subject to specific conditions.  

MODIFICATIONS

MORMEDI, S.L. reserves the right to change, at any time and without prior notice, these TCUW or to make any modification it considers appropriate in the Website, and may change, delete or add any content it considers fit. In any case, we recommend to read these TCUW periodically, as they may vary.

Besides, the user expressly recognizes and accepts that the owner of the Website may, at all times, interrupt, disable and/or cancel any information or service. MORMEDI, S.L. shall try to guarantee availability and accessibility to the Website. However, access to the Website may occasionally be interrupted due to maintenance, updating, etc.  

MORMEDI, S.L. does not take any responsibility for any possible omission, loss of information, data, unauthorized access, breach of confidentiality caused by technical problems, communication problems or human omissions, caused by third parties or non-attributable to the Data Controller, as well as in the event of computer attacks or viruses affecting the systems or equipment of MORMEDI, S.L.

MORMEDI, S.L. may refuse, withdraw, suspend and/or deny access to information and services, at any time and without prior notice, to those users who do not comply with these rules.

RESPONSIBILITY FOR THE WEBSITE

Except in cases where the law expressly requires otherwise, MORMEDI, S.L. does not guarantee or accept any liability for damages that may have been caused by the use and utilization of information, data and services provided by the Website.

In any case, MORMEDI, S.L. is excluded from any liability for damages that may be due to the information and/or services provided or supplied by third parties, with all responsibility resting with said third party, whether collaborator or supplier.  

USER OBLIGATIONS

The user must at all times comply with these TCUW. The user expressly declares that he/she will use the Website in a diligent manner and assumes any liability that may arise from the non-compliance of the rules.

The user undertakes, in those cases where data or information is requested, not to misrepresent his/her identity by impersonating anybody else. The user accepts that the use of the Website shall be carried out for strictly personal, private and individual purposes. The user may not use the Website for activities that are contrary to the law, morality and public order, as well as for any prohibited purposes or purposes that violate or infringe the rights of third parties.

Likewise, the dissemination, storage and/or management of data or contents that infringe the rights of third parties or any regulations governing intellectual or industrial property rights is prohibited.  

The user may not use the Website to transfer, store, disseminate, promote or distribute any data or contents that may contain viruses or any other computer code, files or programs designed to interrupt, destroy or harm the operation of any computer or telecommunications software or hardware.

The user undertakes to indemnify and hold MORMEDI, S.L. harmless for any damage, loss, penalty, sanction, fine or indemnity that MORMEDI, S.L. may be required to pay as a result of the user’s failure to comply with the obligations contained in this document.  

INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

The Website, including its programming, edition, compilation and other elements necessary for its operation, as well as the designs, logos, text and/or graphics, etc. are the property of MORMEDI, S.L. or, if appropriate, has a license or express authorization from the authors.  

All the contents of the Website are duly protected by intellectual and industrial property regulations, as well as recorded in the appropriate public registers.  

Regardless of the purpose for which they were meant, the total or partial reproduction, use, exploitation, distribution and marketing thereof requires in any case the prior written authorization by MORMEDI, S.L. Any use not previously authorized is considered a serious breach of the author’s intellectual or industrial  

property rights. The designs, logos, text and/or graphics not belonging to MORMEDI, S.L. that may appear on the Website belong to their respective owners, and they shall be responsible for any possible dispute that may arise with respect thereto.  

MORMEDI, S.L. recognizes in favor of its owners the corresponding intellectual and industrial property rights, and the mere mention or appearance on the Website does not imply the existence of any rights or responsibility whatsoever over them, nor any endorsement, sponsorship or recommendation by the company. APPLICABLE LAW AND JURISDICTION

These TCUW are governed by and interpreted according to Spanish law. In the event of any complaint, the courts and tribunals of the Spanish territory shall have jurisdiction. All notifications, requests, petitions and other communications that the user wishes to make to the owner of the Website, shall be made in writing and will be deemed to have been correctly made when they are received in the office by post or at the following mailing address: marketing@mormedi.com
